AEJ WINS ARBITRATION AWARD OF $16.8 MILLION IN INSURANCE COVERAGE DISPUTE
Claimants Thomas Berkley Square Housing, LLC and The Bedford Group developed a mixed-use commercial real estate project in Oakland, California beginning in 2006. In lieu of a surety bond, the project was covered by a subguard insurance policy issued by a subsidiary of Zurich American Insurance Company. In 2007, a subcontractor defaulted on its contract, and the general contractor for the project became insolvent and abandoned the project. Zurich denied coverage under the policy and litigated tenaciously for six years. A three-arbitrator panel unanimously found that this parlay of events was insured under the policy, and awarded coverage damages and legal fees to claimants in the amount of $16,839,787.

AEJ WINS A $3.4 MILLION VERDICT FOR RACIAL HARASSMENT AT THE RIVERSIDE PUBLIC UTILITY

Witnesses described the “gang mentality” of staff who plotted to isolate and undermine Mr. Harris - the first black manager within the Public Utility. During a four-week jury trial, AEJ put on the case that management in the City of Riverside knew about the harassment, but caved to union pressure to replace Mr. Harris with a white supervisor. The jury found that Mr. Harris was a victim of racial harassment and that he was constructively fired when management refused to do anything about it.
